My subscription checkbox will not turn off (when starting a new topic) regardless of set to yes or no in Configuration -> Users. Any thoughts?

Check in your profile the setting "Profile -> Edit -> Forum Settings".

That was it. However, this is a test site where i have upgraded from Kunena 3.06 to 5.0.7. I assume at this point for whatever reason this has triggered the personal choice of the checkbox being on in their profile?

This problem has been arise after this feature was added in the profile. But it has no effect on new users. New users get the profile setting Default. Default is the same as in the backend.
If you want change it for existing users, you must do it in the database with this command.
Code:
UPDATE `yourprefix_kunena_users` SET `canSubscribe` = '1'

There are 3 values.
-1 is default (uses the same as in the backend)
1 is Yes
0 is No
