Section 11 of
Terms of Use
clearly states the intellectual property rights of the
Kunena project. Section 11 of the TOU states:
11.1 Kunena and the Kunena logo are registered trademarks of the Kunena Project. Kunena, and all associated software and documentation developed by the Kunena Project, derives from copyrighted works licensed under the GNU General Public Licence. All software products developed by the Kunena Project are licensed pursuant to the GNU General Public Licence as of 29 June 2007 and, as distributed, include or are derivative of, works licensed under the GNU General Public Licence or other free or open source software licences, including other copyrighted works as attributed to within the source code.
11.2 Kunena is open source software that is derived from other work. Kunena is an extension of the Joomla! Project. Joomla! is a registered trademark of Open Source Matters, Inc. in the U.S. and/or other countries. The Kunena Project is not affiliated with or endorsed by Open Source Matters, Inc.
11.3 You acknowledge and agree to include, in any modifications made by you to Kunena, whether or not you distribute such modified software to others, all original copyright notices embedded in the software source code and that you are liable for any representations that you make or civil claims made against you for the performance or non-performance of software you have modified.
11.4 You further agree, and to disclaim, where you engage in the commercial or non-commerical distribution, or redistribution, of products or services using the Kunena name and/or logo, to the inclusion of the following notice in your website's terms of use or on those pages where people may obtain those products or services:
- <Name of website> is not affiliated with the Kunena Project. The Kunena name and logo is used under a limited license granted by the Kunena Project, the trademark holder in the United States and other countries.
11.5 In the event you believe that material or content published on the website may infringe on your copyright or that of another, please contact us at [email protected].
The
Kunena team is pleased that there have been a number of other Joomla extension developers who have developed software that can be used with Kunena - even to the extent of deriving a profit from the work that the team has done for free - but wishes to point out that there are limits to trading off the
Kunena brand and logo.
This website (
www.kunena.org
) is the home of
Kunena but, with the growing number of other products carrying the Kunena name and/or logo, the forum here often becomes the place where people ask questions or refer their problems to the team in matters over which the team has no responsibility. It is important, therefore, that third-party developers who have their products listed on the
Joomla Extension Directory
, pay particular attention to section 11.4 of the TOU. In this regard, the Kunena team believes that other extension developers who choose to use the Kunena name and/or logo in their work, should inform their clients that their work is not endorsed by or affiliated with the
Kunena project.

. The team has examined these products and notes that the business or individuals who offer their products have apparently not fulfilled their obligations under section 11.4 of the
